The judicial authorities will be able to obtain relevant electronic evidence more efficiently in criminal proceedings

On Thursday, April 16, 2026, the Government of Romania adopted the draft law on establishing measures for the implementation of Regulation (EU) 2023/1543 of the European Parliament and of the Council of 12 July 2023 on European Production Orders and European Preservation Orders for electronic evidence in criminal proceedings and for the execution of custodial sentences following criminal proceedings.


The draft law creates the necessary legal framework for the application, at national level, of Regulation (EU) 2023/1543 on European Production and Preservation Orders for electronic evidence, part of the European legislative “e-evidence” package.


Through the new regulations, judicial authorities in Romania will be able to obtain relevant electronic evidence more efficiently in criminal proceedings, including data stored by service providers, thus contributing to combating crime in the digital environment.


The draft establishes the competent authorities for issuing and executing European Preservation and Production Orders for electronic evidence, the working procedures, mechanisms for contestation and judicial review, as well as clear deadlines for handling requests.


It also provides for sanctions applicable to service providers that fail to comply with their legal obligations, in the absence of justified reasons, in accordance with European provisions.

Through this initiative, Romania strengthens its national legislative framework and contributes to enhancing judicial cooperation at the European level, with a view to a faster and more effective response to modern forms of crime.
