Legislative Amendments on Information Exchange in Cases of Terrorism Offenses

On Friday, May 16, 2025, the Ministry of Internal Affairs launched for public debate the draft Law for the completion of Article 22¹ of Law no. 535/2004 on the prevention and combating of terrorism.


The draft law will supplement Chapter II, Section 3 titled Information Exchange of Law 535/2004:


– by specifying that information regarding criminal investigations for terrorism offenses that affect or may affect two or more Member States shall be transmitted to Europol, in accordance with Law no. 56/2018 on the cooperation of Romanian public authorities with the European Union Agency for Law Enforcement Cooperation (Europol) and with Regulation (EU) 2016/794 of the European Parliament and of the Council;


– by stating that the processing of personal data under Council Decision 2005/671/JHA may only take place for the purposes of preventing, investigating, detecting, and prosecuting terrorism offenses and other offenses falling within Europol's competence, in accordance with the purpose limitation principle;


– by more precisely defining the categories of personal data that may be subject to exchange, duly taking into account the operational needs of the relevant authorities.
