The competence of the judicial police officers of the General Anti-Corruption Directorate

On Monday, June 16, 2024, the High Court of Cassation and Justice, through the panel competent to rule on appeals in the interest of the law, legally constituted, delivered an important decision regarding the jurisdiction of judicial police officers within the General Anti-Corruption Directorate, according to a statement by the HCCJ.
By Decision No. 8/2024, the HCCJ upheld the appeal in the interest of the law filed by the Management Board of the Alba Iulia Court of Appeal and ruled that judicial police officers within the General Anti-Corruption Directorate are competent to carry out, by delegation and under the conditions provided by law, the criminal investigation acts ordered by the competent prosecutor exclusively in cases concerning the offenses provided for in Article 1 paragraph (2) of Government Emergency Ordinance No. 120/2005.
This decision is binding, in accordance with the provisions of Article 474 paragraph (4) of the Criminal Procedure Code.
The HCCJ’s decision clarifies and confirms the jurisdiction of judicial police officers within the General Anti-Corruption Directorate to conduct criminal investigation acts in corruption cases, when delegated by the competent prosecutor. This unified interpretation is intended to ensure a coherent and consistent application of the law in combating corruption offenses, thereby strengthening the efficiency and legality of criminal procedures in this field.
