On June 17, 2024, the High Court of Cassation and Justice – the Panel for resolving legal matters in criminal cases, legally constituted, issued the following decision:
By Decision no. 37/2024, the High Court of Cassation and Justice admitted the request made by the Târgu Mureş Court of Appeal – Criminal and Juvenile and Family Section, requesting the issuance of a preliminary ruling to resolve the following legal matter:
Are courts obliged to disregard the resolution of the legal matter concerning the application of the principle of mitior lex in the matter of interrupting the statute of limitations, given by Decision no. 67/2022 of the High Court of Cassation and Justice – the Panel for resolving legal matters in criminal cases, within the limits resulting from the judgment of the Court of Justice of the European Union delivered on July 24, 2023, in case C-107/23 PPU?
and determines that:
Courts cannot disregard the resolution of the legal matter concerning the application of the principle of mitior lex in the matter of interrupting the statute of limitations of criminal liability, given by Decision no. 67/2022 of the High Court of Cassation and Justice – the Panel for resolving legal matters in criminal cases, within the limits resulting from the judgment of the Court of Justice of the European Union delivered on July 24, 2023, in case C-107/23 PPU (limits provided in the operative part of the judgment at point 1, second clause).
The resolution given by Decision no. 67/2022 of the High Court of Cassation and Justice – the Panel for resolving legal matters in criminal cases shall apply, under the conditions established by it, to procedural acts carried out before June 25, 2018, the date of publication of Decision no. 297/2018 of the Constitutional Court.
Mandatory from the date of publication in the Official Gazette of Romania, Part I, according to art. 477 para. (3) of the Criminal Procedure Code.
