The High Court of Cassation and Justice. Decision no. 1/2025 regarding the date of offense in single crimes.

By Decision No. 1/2025, the High Court of Cassation and Justice upheld the appeal in the interest of the law filed by the Prosecutor General of the Prosecutor's Office attached to the High Court of Cassation and Justice and ruled that:

In the uniform interpretation and application of Articles 174 and 154 (2) of the Criminal Code, the date of the commission of the offense and, implicitly, the date from which the statute of limitations for criminal liability begins to run in the case of single offenses under Articles 289–292 of the Criminal Code, where multiple normative modalities of the material element are carried out at different times, shall be understood as the date of the commission of the first alternative modality, independently of any subsequent realization of other alternative modalities contained in the offense and regardless of the time interval between the commission of the first alternative modality and the commission of another alternative modality, or between the acts composing the characteristic action of one of the normative modalities of committing the offense—namely, the date of the first act in a sequence of acts corresponding to a single normative modality.
